What is it?

What Are the Issues?
The Canadian legal system dealt a landmark privacy decision that affected all Canadians when the Federal Court of Appeal issued a ruling on May 19, 2005 in the BMG Canada v. John Doe. This was the music industry’s first attempt at launching an American-style litigation campaign that targeted alleged Canadian file-sharers. The Canadian court refused to share actual names in the court case, protecting citizens from litigation.
This case put Canadian federal privacy rules at odds with current U.S. Security measures in light of the Homeland Security Act and other privacy issues. Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) addresses the collection, storage and use of personal information by organizations in the private sector. Its provisions apply to information collected, used or disclosed by federally regulated agencies, such as telecommunications companies, ISPs, broadcasters, airlines and banks. PIPEDA also applies to federally regulated companies that conduct business online; and it extends to businesses in Nunavut, the Yukon and the Northwest Territories.
Unlike voluntary industry codes, PIPEDA is enshrined in law, and overseen by the Privacy Commissioner of Canada. PIPEDA gives individuals the right to see and correct any personal information about them collected by companies in the course of their commercial activities. These provisions state that businesses must inform consumers of who is collecting the information, why the information is being gathered, and for what purposes it will be used. Online information in this country can be collected only with consumer knowledge and consent, ed only for the reasons for which it was gathered, and is stored securely.
